No new trial for former doctor

June 24, 2009 - 4:57 PM

ST. JOSEPH COUNTY, Mich. (NEWSCHANNEL 3) - A former doctor will not face a new trial in St. Joseph County.

County Prosecuting Attorney John McDonough announced on Wednesday that he will not seek to re-try Terence Whiteman on charges of criminal sexual conduct and delivery of a controlled substance.

Whiteman was convicted of 12 charges in May of 2008, but the conviction was overturned.

Police started investigating Whiteman after some of his patients said he sexually assaulted them at the hospital where he worked.

McDonough said he didn't want the victims to have to testify again.

Whiteman's conviction was overturned due to mistakes made by the judge, prosecutor, the defense attorney, and the investigating officer, Louis Rosado.

Rosado was fired from the Sturgis Police Department in June after being charged with one count of dissemination of confidential information, a misdemeanor. That stems from an unspecified incident in March.

All cases involving Rosado are currently under review.
