911 tape played at Foley murder trial
Comments 0 | Recommend 0COLDWATER, Mich. (NEWSCHANNEL 3) – Jurors in Coldwater are hearing about the smallest bits of evidence, which could have a big impact on the outcome of Thomas Foley's murder trial in Branch County.
Foley is charged with first degree murder for the death of his wife, DeeDee. She was killed in February while she took a shower in her home near Union City.
In court on Tuesday, prosecutors called witnesses to set the scene of the investigation into the killing.
There was testimony about blood found on a shirt belonging to Thomas Foley, and shoe prints found inside the house.
Prosecutors also played the 911 call that Foley placed when he says he found DeeDee's body bleeding in the shower.
The 911 operator asked “What's the matter with her?”
“There's something wrong with her head,” said Foley.
“She what?” asked the operator.
“Something's wrong with her head,” said Foley.
Foley goes on to explain how DeeDee was lying in the shower unconscious and not breathing. As the operator tries to get Foley to move DeeDee to help her, Foley refuses.
“You're right by her right now, right?” asked the operator.
“Yes,' replied Foley.
“Okay,” said the operator.
“I can't look at her, I can't,” said Foley.
“You can't what?” asked the operator.
“I can't look at her,” said Foley, followed by something that cannot be made out in the tape.
“We need to try and help her,” said the operator.
“No,” replied Foley.
“You can't?” asked the operator.
“There's nothing I can do,” said Foley, before screaming, “there's nothing I can do.”
In court, Foley was visibly emotional after listening to the call.
Prosecutors said they would call ballistics experts to the stand next. The trial resumes Wednesday morning.
