Man freed after 25 years in prison in rape of Detroit woman
Comments 0 | Recommend 0DETROIT (AP) - A Wayne County judge has ordered the release of a man who served 25 years in prison for the rape of a pregnant woman in her Detroit home.
Circuit Judge Vera Massey Jones on Wednesday ordered a new trial for Walter Swift, and the prosecutor's office says it will not try him again.
Massey was acting on a joint motion filed by the prosecutor's office and the Innocence Project.
The 47-year-old Swift is represented by the Innocence Project, which has used DNA evidence to clear more than 200 prisoners. The Detroit Free Press says the case turned primarily because of faulty witness testimony.
Prosecutor Kym Worthy says in a statement her office isn't calling Swift innocent but says there is "some doubt about the fairness of the original trial."
