Court hearing gay marriage arguments from 4 states

Court hearing gay marriage arguments from 4 states story image

CINCINNATI (AP) - A Michigan state official says any change in the state's ban on same-sex marriage should come through the political process.

The state's solicitor general, Aaron Lindstrom, opened an afternoon of arguments Wednesday about gay marriage bans in four states before federal appeals judges in Cincinnati. The arguments on Michigan, Ohio, Kentucky and Tennessee cases are the biggest such court session on the issue so far.

Lindstrom says, "The most basic right we have as a people is to decide public policy questions on our own."

But attorney Carole Stanyar says fundamental constitutional rights shouldn't be decided in popular votes. She represents plaintiffs in a case that began when a lesbian couple sued over state law barring them from jointly adopting their children.

Stanyar says the amendment "gutted the democratic process."
