NEW YORK (NEWSCHANNEL 3) - A New York man faces possible jail time for laughing in his own home.
His name is Robert Schiavelli. He suffers from a mental disability and says his neighbor has mocked his disability for years.
Schiavelli now responds by simply laughing at the ridicule, but that neighbor recently called the police claiming Schiavelli was laughing too loud out his window.
Officers issued him two tickets for disturbing the peace.
"I think it's the stupidest thing I've ever heard of in my life," said Schiavelli.
"I really don't think laughing constitutes disturbing the peace," said his mother Suzanne.
During Schiavelli's first court appearance the judge refused to drop the charges.
Each ticket carries up to a 250-dollar fine and up to 15 days in jail.
