New York Mayor will fight court ruling on soda ban

NEW YORK (NEWSCHANNEL 3) - The Mayor of New York is vowing to carry on his fight against obesity.

Michael Bloomberg says the city will file an appeal after a judge struck down his ban on oversized sugary drinks.

The ban was set to go into effect Tuesday morning, but the judge ruled the board of health had no authority to impose a ban and cited the loopholes in the ordinance that allowed certain stores to sell huge sodas, but others couldn't. Plus, not all beverages were banned.

Reactions in the city were mixed.

“I think people should exercise their own autonomy when it comes to what they decide to put in their bodies," said one New Yorker.

"It comes down to individual freedom. Shouldn't be forced to not drink something," said another.

“I think it's unhealthy to have something that sugary for that many ounces," said a third.

Bloomberg's office took to twitter to express its disappointment in the decision, but says he's confident in the end the measure will be upheld.
