Constantine Police request charges in child sex abuse case
CONSTANTINE, Mich. (NEWSCHANNEL 3) - Constantine Police are requesting charges in a shocking child sex abuse case.
It's a story Newschannel 3 first broke in December.
Two separate investigations were launched after police say two 5-year-old boys were involved in sex acts with each other.
Police say it happened in a kindergarten classroom, and in a bathroom at Eastside Elementary School.
Now the lead investigator tells Newschannel 3 they believe one of the kindergarteners was sexually abused by his father.
Constantine Police turned the case over to the St. Joseph County Prosecutor's Office Monday.
Police are requesting the charge of first degree criminal sexual conduct.
What's disturbing is police say this little boy is now living with his father, who is accused of molesting him.
Constantine Police documents show they confronted the child's father in an interview, asking if he had sexually abused his son.
That man told the investigator, "I wouldn't do anything like that. Honestly, sex offender, I got the gun, you give me the bullet, I'll even provide the bullet; that is the way I look at it. Not to say I am going to do it. But why let them live, that is a little kid, they are innocent."
But police tell Newschannel 3 before the boy initiated the sex act with another kindergartner at Eastside Elementary, the child admitted to his family and Michigan State Police, his father had molested him.
When police interviewed the 5-year-old's mother, she said, "Every time he would come back from his father's house he would act out. He would sit under the coffee table and hold his hands over his ears and rock back and forth."
Despite several allegations over the years, the boy's father was never charged, because State Police say the child could not articulate exactly what happened to him.
The investigator in Constantine now fears the prosecutor may drop the case, because of the same reason.
The investigator says it is not uncommon for a child to recant a story, especially when it involves someone they love.
Constantine police say they are not requesting any charges for an adult involving the other 5-year-old, because they could not determine where that child learned the sexual behavior from.
