Young father seeks new trial after daughter's disappearance
LUDINGTON, Mich. (NEWSCHANNEL 3) – The young father convicted in the disappearance of his infant daughter is trying to get a new trial.
Sean Phillips’ four-month-old daughter Kate vanished from her mother’s home in Ludington during the summer of 2011.
Phillips was convicted of unlawful imprisonment, but his attorney now claims prosecutors failed to prove beyond a reasonable doubt that baby Kate was ‘restrained.’
The appeal also claims that the judge deviated from sentencing recommendations.
